On 17 October 2013 the Appeal Court of Milan dismisses the request of Motom / Scooters India Limited to revoke the injunction issued by the Board of Reclamo of 21 March 2013. All use of the mark Lambretta by the parties on European territory is illegal and will be punished.
On 12 July 2013 the Court of Milan dismisses the request of Motom / Scooters India Limited to revoke the injunction issued by the Board of Reclamo of 21 March 2013. All use of the mark Lambretta by the parties on European territory is illegal and will be punished.
On 12 April 2013 the Court of Appeal of Milan declares the revocation for non use of the three Italian Registrations of the Lambretta sign owned by Scooters India Limited. The claim of Scooters India Limited that Lambretta is a famous trademark belonging to Scooters India Limited has been rejected by the Court of Appeal. The decision will be filed in the remaining cases against Scooters India Limited.
On 21 March 2013 the Italian court orders Motom (and therefore Lambretta Motolife Italia SPA, G&L Industrie SRL and CLAG International Ltd) to immediately cease the use of the trademark Lambretta including use on the LN, LS, LT and LJ models on European terroitory. Motom is ordered to pay 10.000 euro penalty per breach of the order. The order has been published in the national newspaper Corriere della Sera of 18 May 2013.
On 16 January 2012, Lambretta Consortium filed with the Inspection Board of the Ministry of Science and Technology (MOST) in Vietnam an official complaint ref. 071/KN requesting the seizure of the infringement of Vinh Phat, the distributor of Motom, Motolife, Clag and DBM in Vietnam. Lambretta Consortium is confident that this action will block Motom from further infringing the trademarks of Lambretta in Vietnam.
On 1 December 2011 the Board of Appeal of the European Patent and Trademark Office (OHIM) confirmed the earlier decision to revoke the European trademarks of Scooters India.
On 15 Februari 2011 the UK intellectual Property Office (UKIPO) confirms the revocation of the UK trademarks of Scooters India.
